EPA Administrator Lisa Jackson now doing Congress' job.

The partisan issue of climate change is also becoming a contest between state and federal authority.

Texas is refusing to comply with what state officials regard as potentially unlawful actions on the part of the Environmental Protection Agency. In a letter dated Aug. 2, state officials accused the EPA of "[threatening] to usurp state enforcement authority and to federalize the permitting program of any state that fails to pledge their fealty." The letter is signed by Texas Attorney General Greg Abbott and state Commission on Environmental Quality Chairman Bryan W. Shaw.

The Environmental Protection Agency has rejected 10 petitions -- including one filed by Virginia Attorney General Ken Cuccinelli -- challenging the climate science research it is using to formulate regulations limiting manmade greenhouse gas emissions.

The petitions asked the agency to reconsider its Endangerment Finding, which asserted that manmade emissions of greenhouse gases have affected climate change and threaten human health and the environment.

The Environmental Protection Agency Thursday rejected an effort to keep it from regulating greenhouse gas emissions, saying that e-mails released in last fall’s “Climategate” scandal gave it no reason to reconsider the science of global warming.

In a sternly written opinion, EPA Administrator Lisa Jackson said she didn’t agree with requests from the GOP attorneys general from Texas and Virginia, the U.S. Chamber of Commerce and other conservative groups that questioned the underlying science linking humans to global warming and also warned of the potential economic burdens from new climate rules.

Ed. note: Regardless of your feelings about smoking and the legal purchase of cigarettes, it seems that federal judges are getting more than a little bit irritated with the Obama administration taking liberties with our constitution. I can only hope that if cap-and-tax legislation passes before the November elections, some brave judge will stand up to the blatant tyranny of this administration.

A federal judge granted a temporary restraining order Monday allowing a Seneca Nation mail-order cigarette retailer to supply tobacco products across the country without having to meet the requirements of a new federal law that took effect at midnight.

The administration plans to use sleight-of-hand politics to sneak through an economy-killing tax on energy as necessary to save the Earth. Make no mistake: Cap-and-trade is a tax every American will pay in every aspect of his or her life.

Cap-and-trade is like Jason Voorhees of the "Friday the 13th" movie series. Just when you think you've killed it, it comes back.

The President has appointed a seven-person commission to take what he says will be an objective look at what caused the Gulf spill and the steps to make offshore drilling safe. But judging from the pedigree of his commissioners, we're beginning to wonder if his real goal is to turn drilling into a partisan election issue.
